Terms of Use

These Terms of Use ("Terms") govern your access to and use of the unified search application available at search.browardmpo.org (the "Service"), operated by the Broward Metropolitan Planning Organization (the "Broward MPO," "we," "us," or "our") with development and operations support from Daruma Tech LLC. By accessing or using the Service, you agree to these Terms.

1. YouTube Terms of Service

The Service uses YouTube API Services to retrieve and display publicly available video content from the Broward MPO's official YouTube channel.

By using the Service, you acknowledge and agree that you are bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms.

You also acknowledge that information accessed via YouTube API Services is subject to the Google Privacy Policy, also available at http://www.google.com/policies/privacy.

2. Permitted Use

The Service is provided as a public information tool to help users find content published by the Broward MPO and related public sources. You may use the Service for lawful, personal, educational, journalistic, civic, and research purposes.

3. Prohibited Conduct

You agree not to:

Use the Service in violation of any applicable law, regulation, or third-party right;
Attempt to gain unauthorized access to the Service, its underlying infrastructure, or any related systems;
Interfere with or disrupt the integrity or performance of the Service, including by submitting automated queries at a rate or volume designed to degrade the Service;
Scrape, harvest, or otherwise extract data from the Service in a manner that circumvents normal use, exceeds reasonable rate limits, or violates the terms of any underlying third-party API (including the YouTube API Services);
Use the Service to redistribute YouTube content in a manner that violates the YouTube Terms of Service; or
Misrepresent your identity or affiliation in connection with use of the Service.

4. Content and Intellectual Property

Content displayed through the Service is owned by its respective rights holders. Broward MPO content is generally available for public use consistent with Florida public records principles and any applicable copyright. YouTube videos and related metadata remain subject to the rights of YouTube, Google, and the original uploader. Other third-party content (podcasts, agendas, mapping data) remains the property of the originating source.

5. Third-Party Content and Links

The Service indexes and links to content from third-party sources, including the Broward MPO's YouTube channel (via the YouTube Data API), Buzzsprout (podcast feeds), AgendaQuick (meeting agendas), and ESRI/ArcGIS Hub (mapping resources). We do not control these third-party services and are not responsible for their content, availability, or practices. Your use of third-party content is governed by the terms and policies of those third parties.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that indexed content will be complete, accurate, or current. Search results are generated automatically and may not reflect the most recent state of source content.

7. Limitation of Liability

To the fullest extent permitted by law, the Broward MPO and Daruma Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service. Nothing in these Terms limits any rights or remedies that cannot lawfully be limited under applicable law, including the sovereign immunity protections afforded to the Broward MPO under Florida law.

8. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Venue for any dispute arising under these Terms shall lie in the appropriate state or federal courts located in Broward County, Florida.
